An individual working in a
boiler plant suffered a catastrophic injury (burns and quadriplegia) when
a boiler malfunctioned. The investigation revealed that the manufacturer
of the boiler used an inferior/defective product, which caused the malfunction.
To discharge the patient, significant home modifications were needed.
The workers' compensation carrier was the self-insured employer. Most
workers' compensation carriers and self-insured employers are not required
to pay for home modifications or for the cost of purchasing a new home.
As a result of the lawsuit that was filed against the manufacturer, I
was able to convince the self-insured employer to pay for the purchase
of a home to meet the needs of the patient while the litigation against
the boiler manufacturer continued.
