I was retained by a cancer patient who was seeking payment from her health insurer for aggressive cancer treatments. The appeals hearing was scheduled, but the patient's condition was deteriorating and she was unable to personally testify at the hearing. I videotaped my client's deposition and presented the videotape as an exhibit before the appeals committee, and was successful in winning the appeal and obtaining the needed cancer treatments for her illness.

Attorneys should monitor their clients' physical condition in order to insure that the client will be fit to appear for a deposition or appeal hearing.
